Data Protection Declaration of Continental Tyre PJ Malaysia Sdn. Bhd. for the Application ECHO App

Continental Continental Tyre PJ Malaysia Sdn. Bhd. is making available the smartphone application ECHO App. This App allows  upload of photos during warranty complaint handling for tire products of the Continental Tire Division. After creating the complaint in the Online Complaint Handling webmodule in ContiOnlineContact, the photos can be attached via the ECHO App.

Continental Tyre PJ Malaysia Sdn. Bhd. processes your data in the context of your use of the ECHO App  in compliance with the applicable legal regulations.

§ 1 Scope

Personal data entered by you is collected, processed and used by Continental Tyre PJ Malaysia Sdn. Bhd. for the purpose of contract execution within the framework of your use of the warranty complaint handling process. Insofar as this is necessary for the execution of the contract, the data may be passed on to the companies affiliated with CONTINENTAL TYRE PJ MALAYSIA SDN. BHD. pursuant to sections 15 et seqq. of the German Stock Corporation Act as stipulated in the Binding Corporate Rules of Continental.

If permitted and/or prescribed by law, the data may be evaluated for reporting purposes (e.g., statistics).

Your data will be collected, processed and used solely in compliance with the applicable data protection regulations (e.g., your consent).

In accordance with the statutory provisions, all your data is treated as strictly confidential.

§ 2 Functioning of  ECHO App

Installation of  ECHO App

Use of the  ECHO App  requires the installation of this App and the user’s proper consent to the Terms of Use and the Data Protection Declaration.

§ 3 Collection, Processing and Use of Data in the  ECHO App

Continental Tyre PJ Malaysia Sdn. Bhd. only stores personal data relating to users of its  ECHO App  if consent for this has been provided.

Personal user data is solely used to process inquiries within the context of the consent granted or in compliance with applicable data protection regulations. Based on legal requirements, Continental has enforced global, uniform and internal Data Protection Rules (Binding Corporate Rules) regulating the protection of your personal data.

The following personal data will be collected when the App is used:

  • User-ID
  • Name
  • Company name and address
  • E-mail
  • Telephone

Continental Tyre PJ Malaysia Sdn. Bhd stores the above listed data entered / and/or data provided for the process / service only for the purpose of communicating personally with you. Your data is erased once processing of your inquiry/concern has concluded, provided that this erasure does not conflict with any statutory duties to retain records.

Furthermore Continental Tyre PJ Malaysia Sdn. Bhd. uses the e-mail address of the user after it is expressly consented to inform on updates on  ECHO App.

§ 4 Information Rights of User

Please note that, as a data subject, pursuant to the EU General Data Protection Regulation (EU GDPR), you have the following rights in connection with the processing of your personal data:

In accordance with Article 21 EU GDPR, you have the right to withdraw your consent to the collection, processing/storage and use of your personal data at any time. Consent must be withdrawn by writing to Continental Tyre PJ Malaysia Sdn. Bhd. 2nd Floor, CTM Technology Centre, 2, Jalan Tandang, 46050 Petaling Jaya, Selangor, Malaysia. or by sending an e‑mail ric@conti.my.

§ 5 Protection of stored data

Our company uses technical and organisational security measures to protect the personal data provided by you from manipulation, loss, destruction or from being accessed by unauthorized persons. The security measures are continually improved and adapted in accordance with the latest technology. Data provided that is unencrypted could potentially be viewed by third parties. For this reason, we would like to point out that, with regard to data transmission over the Internet (e.g., by e-mail), secure transfer cannot be guaranteed. Sensitive data should therefore either not be transmitted at all or only via a secure connection (SSL). If you access pages and files and are then asked to enter personal data, please note that the transmission of such data via the Internet may not be secure and that there is a risk that it may be viewed and manipulated by unauthorized persons.

§ 10 English Version to Prevail

This Data Protection Declaration is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.

§ 11 Closing Provisions

Continental reserves the right to change or amend this Data Protection Declaration in the interests of the  ECHO App  at any time with effect for the future, provided that such changes are not unreasonable for the User. This shall be the case in particular if the changes do not involve any substantial detriment to the User, e.g. with changes in contact information, the commencement of additional services or any similar matters.

In each case of intended change to this Data Protection Declaration Continental shall give reasonable notice to the User of at least 30 days prior to any change coming into force.  Such notification shall take place via email to the email address provided by the User upon registration or via pop-up window in case a registration was not required.

The User has to give his consent to the changed Data Protection Declaration to continuing the use of  ECHO App  by ticking the respective opt-in box of the pop-up window or trough renewed logging in.
