Data Protection Declaration of Continental [Benelux bv/srl] for the Application [ECHO]

Continental [Benelux bv/srl] is making available the smartphone application [ECHO]. This App allows [taking pictures of a complained tire].

Continental [Benelux bv/srl] processes your data in the context of your use of the [ECHO app] in compliance with the applicable legal regulations.


§ 1 Scope 

Personal data entered by you is collected, processed and used by Continental Benelux bv/srl for the purpose of contract execution within the framework of your use of the online shop/application process . Insofar as this is necessary for the execution of the contract, the data may be passed on to the companies affiliated with Continental Benelux bv/srl to sections 15 et seqq. of the German Stock Corporation Act as stipulated in the Binding Corporate Rules of Continental.

If permitted and/or prescribed by law, the data may be evaluated for reporting purposes (e.g., statistics).

1. Installation of [ECHO app]

 Use of the [ECHO app] requires the installation of this App and the user’s proper consent to the Terms of Use and the Data Protection Declaration.

2. Registration on [ECHO app]

The use of the [ECHO app] requires registration by stating the first and last name and choosing a password via [ECHO app] . For the purpose of honest and fair dealing with each other the user is requested to provide true information and their real name [The user first receives a user-ID as username within the registration process; the user is free to change its user name later individually.] Furthermore the user has to give their prior consent to the Terms of Use and the Data Protection Declaration.

3. Login to [ECHO app] via Facebook

Users who are already members of "Facebook" (www.facebook.com) also have the option of registering with[ECHO] via their existing Facebook account ("Facebook Connect"). In this case, the user must grant authorization to transfer certain information to the[ECHO] application and to write on the "Facebook whiteboard"] when logging in for the first time. The login to[ECHO] is then done by entering the "Facebook"-login data of the user]. To log in you will be redirected to the Facebook page where you can log in with your usage data]. This links your Facebook profile and our service. This link automatically provides us with the following information from Facebook Inc:

We only use your [name, your e-mail address,]. This information is absolutely necessary for the conclusion of the contract in order to be able to identify them.

4. communication between App users

The app only allows the transfer of the personal data of the user[as well as his vehicle data] to Continental[or cooperation partner of Conti-nental (garages)]. There is no exchange of personal or other data between the users of the app. This also applies to the mes-saging service, which alone enables the exchange of messages between the user and Continental[or the cooperation partner of Continental (workshop)].].


§ 3 Collection, Processing and Use of Data in the [ECHO app]

Continental [Benelux bv/srl] only stores personal data relating to users of its [ECHO app] if consent for this has been provided. The only data that is stored relates to the date and time of the use of the app, the pages visited, the page functions used, …] Continental [Benelux bv/srl] uses this information to measure website activity, to produce statistics, and to improve the services and information provided via the app.

Personal user data is solely used to process inquiries within the context of the consent granted or in compliance with applicable data protection regulations. Based on legal requirements, Continental has enforced global, uniform and internal Data Protection Rules (Binding Corporate Rules) regulating the protection of your personal data.

The following personal data will be collected when the App is used:

  • E-mail address
  • User-ID
  • Password 

Continental [Benelux bv/srl] stores [data entered / and/or data provided for the process / service]such as [name, company, e-mail, address and telephone] only for the purpose of communicating personally with you. The data is stored and/or used solely for the purpose of processing your inquiry/concern/participation in the competition. Your data is erased once processing of your inquiry/concern has concluded, provided that this erasure does not conflict with any statutory duties to retain records.

Furthermore Continental [Benelux bv/srly] uses the e-mail address of the user after its expressly consent to inform on updates on [ECHO app] .

In each case of intended change to these Data Protection Declaration Continental shall give reasonable notice to the User prior to any change coming into force.  Such notification shall take place via email to the email address provided by the User upon registration or via pop-up window in case a registration was not required.

The User has to give his consent to the changed Data Protection Declaration to continuing the use of  [ECHO app] by ticking the respective opt-in box of the pop-up window or trough renewed logging in.
