Data Protection Declaration

Welcome to Continental Tyre SA (Pty) Ltd (“Continental”) CONTI ECHO APP mobile application (“Mobile App” or “Service” or “App”). This Data Protection Notice together with the Terms of Use describes how Continental uses and protects any personal information (i.e. information that can be used to identify You) that Continental collects about You when You set-up and use the Service. It also outlines how Continental uses the information it collects about You. By using the Service, You agree to the terms of this Policy, and consent to Continental’s use of the information we collect through the Service.

§1 General

The App allows the upload of photos during warranty complaint handling for tire products of the Continental Tire Division. After creating the complaint in the Online Complaint Handling webmodule in ContiOnlineContact, the photos can be attached via the ECHO App.

Personal data entered by You is collected, processed and used by Continental for the purpose of contract execution within the framework of Your use of the Mobile App. Insofar as this is necessary for the execution of the contract, the data may be passed on to the companies affiliated with Continental pursuant to sections 15 et seqq. of the German Stock Corporation Act as stipulated in the Binding Corporate Rules of Continental.

If permitted and/or prescribed by law, the data may be evaluated for reporting purposes (e.g., statistics).

Your data will be collected, processed and used solely in compliance with the applicable data protection regulations (e.g., Your consent).

In accordance with the statutory provisions, all Your data is treated as strictly confidential.

§2 Collection and processing of data

Continental only stores personal data relating to users of its Mobile App if consent for this has been provided. The only data that is stored relates to the date and time of the visit, the pages visited, cursor use on the website, the page functions used, and the website from which the user accessed Continental’s websites. The IP address is transmitted anonymously and is only used to assign a geographical location at the city level. Continental uses this information to measure website activity, to produce statistics, and to improve the services and information provided via the websites.

Personal user data is solely used to process inquiries within the context of the consent granted or in compliance with applicable data protection regulations. Based on legal requirements, Continental has enforced global, uniform and internal Data Protection Rules (Binding Corporate Rules) regulating the protection of Your personal data.

Continental stores data entered into its Mobile App and/or data provided for the process such as name, company, e-mail, address and telephone only for the purpose of communicating personally with you. The data is stored and/or used solely for the purpose of processing Your inquiry/concern/participation in the competition. Your data is erased once processing of Your inquiry/concern has concluded, provided that this erasure does not conflict with any statutory duties to retain records.

2.1 How Continental Uses Your Personal Information

Continental employees may have access to Your personal information in order to provide the Service and respond to Your requests for information. We may also provide Your personal information to third-party vendors who supply Continental with software applications, web hosting and other technologies or services necessary to supply the Service. Unless You give these vendors consent, they are only permitted to use Your personal information as needed to supply the Service.

Except as provided in this Policy, it is Continental's policy not to provide third party access to Your information unless You provide written consent or as required (a) by legal process, (b) to maintain the security and integrity of the Service or to protect the security of any of our users, (c) in connection with a business transition involving Continental as outlined below, or (d) to comply with applicable law. If Continental receives legal process seeking the production of Your personal information Continental will attempt to notify You (unless prohibited by law) as soon as possible so that You have reasonable opportunity to oppose the production in the legal proceeding.

§3 The data subject’s rights

3.1 Please note that, as a data subject, pursuant to the EU General Data Protection Regulation (EU GDPR), and in accordance with the relevant provisions of Protection of Personal Information Act (POPIA), You have the following corresponding rights in connection with the processing of Your personal data:

3.2 In accordance with Article 7 (3) EU GDPR and provisions contained in POPIA, You have the right to withdraw Your consent to the collection, processing/storage and use of Your personal data at any time. §4 Protection of stored data

Our company use technical and organizational security measures to protect the personal data provided by You from manipulation, loss, destruction or from being accessed by unauthorized persons. The security measures are continually improved and adapted in accordance with the latest technology. Data provided that is unencrypted could potentially be viewed by third parties. For this reason, we would like to point out that, with regard to data transmission over the Internet (e.g., by e-mail), secure transfer cannot be guaranteed. Sensitive data should therefore either not be transmitted at all or only via a secure connection (SSL). If You access pages and files and are then asked to enter personal data, please note that the transmission of such data via the Internet may not be secure and that there is a risk that it may be viewed and manipulated by unauthorized persons.

§5 Modifications

Continental may modify this Data Protection Notice from time to time without further notice. If we change the aforementioned, we will post a new statement on our Site and change the date indicated at the bottom of the statement. You are encouraged to review this Data Protection Notice from time to time for any updates or changes. Please see our CONTI ECHO APP Terms of Use (available within the CONTI ECHO APP mobile application) for a more detailed legal explanation of our usages policies. Changes to the Policy become effective immediately upon notice to You. Notice may be given by posting the revised Data Protection Notice on this Site or by other means. Your use of the Service after notice constitutes Your acceptance of the revised terms.

§6 Security

Continental takes reasonable precautions to protect Your personal information. For example, we encrypt certain communications using industry standards for encrypting such communications. However, we do not guarantee the security of Your information. There is always a risk that information we collect or You provide may be compromised. To mitigate this risk, You should (a) use secure usernames and passwords and carefully protect them from disclosure and (b) implement up-to-date security and virus protection on Your device. If You suspect that Your device’s security or Your information has been compromised, or Your password accessed or used by an unauthorized third party, please contact us immediately to have Your password changed.

§7 Aggregated and Anonymized Information

We may remove identifying data from Your personal information and combine or aggregate it with other anonymized information for various uses, including to better understand how You and other subscribers use the Service and to enhance the Services. Continental does not consider such aggregated or anonymized information to be personal information and may share such information with third parties.

§8 IP Addresses

An IP address is a number that is assigned automatically to Your device when You connect to the world wide web. Your device is identified by its IP address. Continental collects IP addresses for system administration and to audit the use of the Service. When You access the Site or the Service, we log Your Device’s IP address but, except as above, we do not link IP addresses to Your personal information.
